Terms of service
1. Acceptance of Terms
These Terms govern your use of the Website, and any purchase and/or rental of Items (including Equipment and Travel Packages). By using the Website or placing an Order (online, in person, by phone, or email) you agree to be bound by these Terms and any Cosy Camp policies referenced here (together, the Agreement). If you do not agree, do not use the Website or place an Order.
Cosy Camp may update the Website, Items, these Terms and/or policies at any time in its sole discretion. Your continued use or any subsequent Order constitutes acceptance of the updated Terms.
2. Orders
2.1 Offers and acceptance
(a) Displayed Items are an invitation to treat.
(b) Your Order is an offer to buy and/or rent Items.
(c) By submitting an Order you nominate, as applicable: (i) the Rental Period; (ii) the Participants; and (iii) the Designated Address.
(d) An Order is accepted only when: (i) Cosy Camp receives full payment (including shipping); and (ii) Cosy Camp sends an Order Confirmation.
(e) If after acceptance an Item becomes unavailable, you may: (i) select an alternative of equal value; or (ii) receive a refund for the unavailable Item. In either case you release Cosy Camp from any related claims.
2.2 Customer information
(a) If you provide another person’s address or details, you confirm you have their consent.
(b) You warrant all information provided with an Order is complete, true and accurate.
(c) Review your Order carefully (including quantities). Changes/cancellation may not be possible after acceptance. If shipment has not occurred, Cosy Camp will use reasonable efforts but cannot guarantee changes.
(d) To the extent permitted by law (including the Australian Consumer Law), Cosy Camp is not liable for loss arising from incomplete/incorrect information or from an inability to change or cancel after acceptance.
(e) Separate Orders ship separately and may incur separate delivery fees.
3. Pricing & Payment
3.1 Prices
(a) You agree to pay the price shown at checkout plus shipping and any duties/taxes/levies.
(b) Payment methods include major cards, Apple Pay and other methods enabled by Cosy Camp’s third-party processors (e.g., Shopify, PayPal, Afterpay, Zip Pay). Third-party fees may apply. SSL is used for online transactions and card details are not stored on the Website.
(c) Prices may change at any time. New prices apply to Orders placed after the change.
(d) If you initiate a chargeback, or use fraudulent payment details, Cosy Camp may cancel the Order and refuse future dealings.
(e) Unless stated otherwise, prices are in AUD and include GST.
(f) Cosy Camp may apply or set off any amounts received against amounts you owe under this Agreement.
3.2 Card authorisation
On request you must provide valid card details and authorise Cosy Camp to charge any amounts owed under this Agreement (including amounts exceeding any Security Deposit). You release Cosy Camp from claims arising from such charges.
4. Acknowledgements
You acknowledge that:
(a) colours/finishes/sizing may vary slightly from images;
(b) you are responsible for any additional tools or materials required for your Activity;
(c) Items may not meet every requirement of your Activity;
(d) Items must be used only for their intended purpose and in accordance with instructions;
(e) you must promptly notify Cosy Camp of any damage/issue on delivery and provide evidence (e.g., photos), otherwise damage may be deemed caused by you;
(f) Items are manufactured by third parties and, unless required by law, Cosy Camp provides no additional warranties;
(g) for consumables, you are solely responsible for ensuring suitability, including allergies and dietary/health requirements for you and any other consumer.
5. Promotional Codes, Gift Certificates & Credits
5.1 Promotional codes
One code per Order. Misuse may result in cancellation, modification, or suspension of the code or Order. No warranties are made regarding codes.
5.2 Gift certificates/credits
May be offered subject to conditions set by Cosy Camp (e.g., expiry, non-stacking with other offers).
6. Your Responsibilities
You:
(a) will provide accurate and current information (including Participant numbers);
(b) warrant you are 18+;
(c) warrant you and any Participants have the skills/ability to safely complete the Travel Package/Activities;
(d) warrant you understand safe, correct use of Items and will follow instructions;
(e) acknowledge any “free of charge” consumables are not sold separately;
(f) acknowledge data charges may apply to your use of the Website;
(g) will promptly notify Cosy Camp of problems/defects with Items or Trip Information;
(h) use the Website/Items at your own risk and only for their intended purpose;
(i) warrant you are not allergic to any Item you will use/consume;
(j) will be courteous toward Cosy Camp staff and third parties encountered through your Travel Package; and
(k) if you create an account or place an Order on behalf of a business, you warrant authority to bind that entity and personally guarantee the entity’s obligations.
7. Prohibited Conduct
You must not:
(a) use the Website or Items unlawfully or beyond intended use;
(b) access/use another user’s account;
(c) infringe third-party rights;
(d) abuse, harass, defame, bully, intimidate, or offend others;
(e) disparage Cosy Camp or act to damage its reputation;
(f) introduce harmful code or content;
(g) reverse engineer or decompile the Website;
(h) hack or attempt unauthorised access;
(i) send unsolicited promotional content to Cosy Camp or its customers; or
(j) assign or transfer rights/obligations without Cosy Camp’s prior written consent (any unauthorised transfer is void).
8. Website Changes & Advertising
Cosy Camp may, at any time and without notice: (a) modify, suspend, or terminate Website access; (b) assign rights under this Agreement; and/or (c) display third-party ads or promotions. Cosy Camp is not a party to transactions with third-party advertisers.
9. Intellectual Property
9.1 Ownership
The Website, Trip Information, and all related content and materials (the Cosy Camp IP) are owned or controlled by Cosy Camp and/or its related entities (as defined in the Corporations Act 2001 (Cth)). All goodwill in the Cosy Camp IP remains with Cosy Camp.
9.2 Limited licence
Upon Order acceptance, Cosy Camp grants you a non-exclusive, revocable, non-sublicensable licence to:
(i) use Trip Information and rented Items during the Rental Period, only for their intended purpose and in line with these Terms and Cosy Camp’s instructions; and
(ii) use the Website to purchase and/or rent Items.
You must not: (a) use the Cosy Camp IP beyond this licence; (b) imply endorsement; (c) reproduce/distribute/create derivatives; (d) imitate the “Cosy Camp” branding; (e) use data mining/robots; (f) use the Cosy Camp IP in a manner that may damage Cosy Camp or its reputation; or (g) use the Cosy Camp IP for commercial purposes without consent. No trademark rights are granted without prior written consent.
10. Termination
Cosy Camp may terminate your licence and/or access (including to Items and Cosy Camp IP) immediately if you breach this Agreement.
11. Liability & Indemnity
11.1 Limitation
(a) Unless required by law, Items, Trip Information and the Website are provided “as is” without warranties. To the extent permitted by law, all implied warranties are excluded.
(b) You waive and release claims against Cosy Camp and related entities for: (i) errors/omissions/delays or interruptions of the Website or Items; (ii) delivery/collection delays; (iii) inaccuracies in Trip Information; (iv) third-party content; and (v) accidents, property loss/damage, death or injury arising from use of Items/Trip Information (you use them at your own risk).
(c) To the extent permitted by law, Cosy Camp and its related entities are not liable for indirect or consequential loss. You may not bring actions against Cosy Camp’s directors or affiliates.
(d) In any event, Cosy Camp’s aggregate liability is capped at the value of your applicable Order.
11.2 Indemnity
You release and indemnify Cosy Camp and its related entities against all claims, losses, costs (including legal fees) arising from: (a) your fraud, negligence, misconduct or breach of this Agreement; (b) your use/consumption of Items; and/or (c) your Orders.
12. Website Terms
(a) The Website and content are protected by copyright. No IP rights are granted to you.
(b) While care is taken, Cosy Camp does not warrant completeness or accuracy and is not liable for errors/omissions or system interference/damage. Where liability cannot be excluded, it is limited to resupplying the relevant information.
(c) To the maximum extent permitted by law, you release Cosy Camp and related entities from claims connected to your use of Website materials.
(d) Third-party links are provided for convenience; Cosy Camp is not responsible for their content/activities.
(e) Linking is permitted only to full HTML pages (no deep-linking to secure areas). Contact us for brand assets.
(f) Cosy Camp does not warrant files/data/programs are virus-free; use at your own risk.
(g) Personal information is handled under our Privacy Policy.
(h) Access is currently free; Cosy Camp may introduce fees later.
(i) Cookies may be used; you consent (browser settings may disable cookies).
13. General
13.1 Interpretation
References include persons and entities; legislation includes modifications/re-enactments; times are Australia/Melbourne; “writing” includes electronic; joint/several obligations apply; “including” is not limiting; singular includes plural and vice-versa.
13.2 Governing law & venue
Victoria, Australia law governs. Courts of Victoria have exclusive jurisdiction. Times referred to are Australia/Melbourne unless stated otherwise.
13.3 Entire agreement
This Agreement is the entire agreement for the subject matter and supersedes prior representations.
13.4 Severability
Invalid provisions are severed without affecting the remainder.
13.5 Notices
Cosy Camp may send notices to your nominated email. Notices are deemed received when sent.
13.6 Force majeure
No breach for delays/failures due to events beyond reasonable control (e.g., natural disasters, strikes, war, government action).
13.7 Construction
These Terms benefit Cosy Camp and may be waived by Cosy Camp in writing. In any interpretive dispute, Cosy Camp’s reasonable interpretation prevails.
13.8 No waiver
Failure or delay to enforce is not a waiver. Waivers must be in writing and signed.
14. Definitions
Activity: camping, hiking, kayaking or similar activities.
Cancellation Fee: a fee determined by Cosy Camp if an Order is cancelled by you or due to your breach.
Claim: all claims, losses, damages, costs and liabilities.
Collection: pickup of Items from the Designated Address by Cosy Camp or a Courier.
Courier: a third party engaged to deliver or collect Items.
Delivery: delivery of Items to the Designated Address.
Dispatch: when Items leave Cosy Camp’s facility.
Equipment Rental: rental of Items (title does not pass).
Designated Address: the address you nominate for Delivery and/or Collection.
Items: goods, Equipment, consumables, Travel Packages and Trip Information offered for rent or sale.
Order: your order to rent and/or purchase Items.
Participant: a person using an Item or participating in a Travel Package.
Policies: Cosy Camp policies referenced on the Website.
Price: the price set by Cosy Camp for Items/Services.
Promotional Code: a promotional code made available by Cosy Camp.
Rental Period: the period agreed at checkout or in writing for your rental.
Return: when an Item arrives back at Cosy Camp’s facility.
Sale: purchase of an Item (title passes).
Security Deposit: an amount payable before the Rental Period commences.
Services: campsite/transport bookings and related services provided by Cosy Camp.
Trip Information: route notes, maps, guides and safety information for a Travel Package.
Travel Package: a curated package that may include Trip Information, transport components and rental Items.

You: the person or entity using the Website or placing an Order.
15. Security Deposit (Rentals)
(a) A Security Deposit may be required and must be paid before Delivery.
(b) Cosy Camp may deduct from the Security Deposit amounts needed to repair damage, replace Items, cover late returns, cleaning, loss, theft or other amounts owed under these Terms.
(c) The Security Deposit (less deductions) will be refunded within 90 days after the Rental Period ends.
(d) If no deposit was taken, Cosy Camp may charge your card for any such amounts.
16. Delivery & Return of Rental Items
16.1 Delivery
(a) Subject to compliance with these Terms, Cosy Camp will deliver your rental Items.
(b) Delivery is to the Designated Address, subject to Cosy Camp’s delivery requirements.
(c) Cosy Camp aims (but does not guarantee) to deliver before the Rental Period starts and may, at its discretion, extend the Rental Period, refund relevant Rental Fees, or offer another remedy if delivery occurs later.
(d) If the address is incorrect, inaccessible/unsafe, or you are unavailable, the Order may be deemed cancelled and the full Price forfeited. Redelivery may incur additional delivery and rental charges.
(e) Risk in Items passes on Dispatch and remains with you until Return.
(f) Orders with multiple Items may be delivered separately.
(g) You may be asked to acknowledge these Terms on delivery. Refusal may result in cancellation and a Cancellation Fee.
16.2 Return
(a) Prepare Items for Collection on the Business Day after the Rental Period ends (unless Cosy Camp instructs otherwise): clean, dry, complete, properly packed and labelled by 9:00am local time.
(b) Hold Items for Collection until collected. Notify Cosy Camp if not collected by 6:00pm on the scheduled date.
(c) If you cannot return as instructed, follow Cosy Camp’s return instructions (which may require you to arrange return at your cost). Additional collection and late fees apply for each day the return is late.
(d) If Items are misdelivered or mis-returned after Collection, follow Courier/Cosy Camp instructions.
(e) If Items are missing, damaged, incomplete or dirty on return and there is a dispute with the Courier about when the issue occurred, the Courier’s advice will prevail unless Cosy Camp determines otherwise.
17. Travel Packages
(a) Travel Packages include Trip Information and may include transport components. Actual conditions and campsite availability may vary. You release Cosy Camp from liability for reasonable variations.
(b) Purchasing a Travel Package grants a limited licence to use Trip Information under clause 9.2. No ownership rights in Trip Information pass to you.
(c) Packages may include for the Rental Period: (i) one tablet preloaded with Trip Information; (ii) one compass; and (iii) transport inclusions (e.g., ferry or bus tickets) if specified.
18. Rental Conditions
(a) Rental grants a limited licence to use Items under clause 9.2.
(b) You must: (i) use/store Items with due care and per instructions; (ii) avoid damage; (iii) use Items only for intended purposes; (iv) return Items in the same condition (fair wear and tear excepted); and (v) indemnify Cosy Camp for losses/costs from damage, loss or misuse.
(c) No ownership in rented Items passes to you.
(d) Consumables may be used during the Rental Period for their intended purpose; return remaining consumables and any provided storage bags (food itself is not returnable).
19. Services
Where Cosy Camp provides Services in connection with your Order:
(a) provision is at Cosy Camp’s discretion;
(b) you are responsible for third-party fees unless included;
(c) Cosy Camp may choose the manner and timing;
(d) you consent to necessary disclosures of your information to third parties (e.g., campsite bookings, transport, couriering);
(e) Services may cease if you breach these Terms; and
(f) you release Cosy Camp from claims arising from Services provided.
20. Emergency Situations
(a) Remote areas may have limited mobile coverage and inherent risks. Cosy Camp recommends each Participant carries a personal locator beacon (PLB), satellite phone, first-aid kit, and has basic first-aid training. Proceed at your own risk if you choose not to.
(b) In an emergency, activate the PLB and/or contact rescue services per device instructions. You acknowledge: (i) rescue services will attempt to locate you; (ii) Cosy Camp will use reasonable endeavours to assist authorities (without liability for inability or the nature of assistance); and (iii) you are responsible for rescue and related costs not covered by insurance.
(c) Use first-aid equipment with care and in accordance with training.
21. Cancellations (Rentals & Packages)
21.1 By Cosy Camp
(a) Orders may be cancelled at any time. If cancelled other than for your breach, amounts paid will be refunded within 14 days. If cancelled due to your breach, Cosy Camp may retain a Cancellation Fee and refund the balance.
21.2 By you (general rule)
(a) Within 24 hours of submitting an Order: full refund less any out-of-pocket expenses incurred.
(b) After 24 hours: Cosy Camp may retain a Cancellation Fee and any out-of-pocket expenses (unless Cosy Camp agrees otherwise).
21.3 Rental Packages
(a) No cancellations. Once a Rental Package is booked and accepted, it cannot be cancelled and no refund will be provided (except where required by law).
(b) One-time date change. You are entitled to one date change per Rental Package Order, provided that:
(i) the change is requested in writing at least 7 days before the originally booked start date;
(ii) the requested new date(s) are subject to availability;
(iii) you pay any difference in Price (if the new date(s) are higher in cost) and any additional delivery/collection or third-party fees; and
(iv) any previously issued promotional benefits tied to specific dates may be unavailable on the new date(s).
(c) Additional changes. Any further date-change requests (beyond the one-time change) will be treated as a cancellation and managed under clause 21.2(b) (unless Cosy Camp agrees otherwise in writing).
22. Sales – Delivery (Purchased Goods)
(a) Cosy Camp will supply purchased Items to the Designated Address, subject to delivery requirements.
(b) Transit times are estimates only. Reasonable efforts will be made to deliver within indicative timeframes.
(c) Cosy Camp is not responsible for delays outside its control (e.g., stock issues). If delivery is not made within a reasonable time, contact us to request cancellation/refund.
(d) Incorrect/inaccessible addresses or failed delivery attempts may incur additional fees or lead to cancellation with a refund less delivery charges, at Cosy Camp’s discretion.
(e) Additional delivery charges may apply for bulky/oversize Items or difficult access; Cosy Camp will notify you.
(f) Risk and title pass on Dispatch.
(g) Multi-item Orders may ship separately.
23. Conditions of Sale
(a) You must prepay the purchase price and delivery costs.
(b) Goods may be out of stock or withdrawn without notice. To the extent permitted by law (including the Australian Consumer Law), Cosy Camp is not liable for loss arising from unavailability.
(c) Additional terms of sale notified by Cosy Camp apply.
(d) An on-screen confirmation is not acceptance; acceptance occurs upon emailed confirmation.
24. Returns / Defective or Damaged Goods (Sales)
(a) Inspect goods on delivery and contact Cosy Camp within 24 hours if incorrect, damaged, or faulty.
(b) See Cosy Camp’s Refunds & Returns Policy (incorporated into these Terms).
(c) Provide proof of purchase and, where permitted by law, return all accessories in original packaging to avoid transit damage. Packaging protects the goods and is not itself refundable.
25. Price Match Policy (Retail Sales)
We’ll match the delivered price of any Australian authorised retailer with a physical store.
Eligibility:
Competitor requirements: physical retail store open to the public; offered to all customers; Australian warranties; dispatch from within Australia. Not eligible: online-only retailers, marketplaces/auctions, classifieds, private sellers.
Product requirements: identical brand/model/colour/size/SKU; in stock at both retailers; new, factory-sealed with AU warranty; Australian supply (no grey imports).
Comparison rules: we compare the competitor’s final delivered price to your address (including GST, shipping, surcharges and mandatory fees). Free shipping = item price. Comparable delivery services for bulky items.
Exclusions (non-exhaustive): clearance/run-out/floor stock/ex-demo/refurb/open-box/seconds/used; liquidation or error pricing; bundles, coupons, GWP, multi-buy, loyalty/staff/corporate/education pricing; membership-only pricing; limited-quantity doorbusters, sub-4-hour flash sales, unverifiable offers; services and shipping upgrades; offers breaching supplier/legal obligations.
26. Price Guarantee Policy
26.1 Overview
Cosy Camp is committed to providing fair and transparent pricing. If the price of an identical item you purchased or rented from Cosy Camp is reduced within 14 days of your original purchase or rental date, you may be eligible for a store credit equal to the difference between the price you paid and the new sale price.
26.2 Conditions of eligibility
(a) The lower price must be publicly advertised on Cosy Camp’s official website and available for immediate purchase or rental.
(b) The item must be identical in every respect — including brand, model, size, colour, and condition — and not subject to limited-time flash sales (under 4 hours), bundle deals, or special event discounts.
(c) Requests must be submitted within 14 calendar days of the original transaction date by contacting Cosy Camp through the Website’s contact form or email.
(d) The store credit will be issued to your Cosy Camp account once the price adjustment is confirmed. Store credit cannot be exchanged for cash and will remain valid for 12 months from the date of issue.
(e) This policy applies per item, once per Order.
26.3 Exclusions
The price guarantee does not apply to:

Pricing errors or misprints.

Clearance, end-of-line, or final sale items.

Price differences resulting from third-party promotions, coupons, loyalty points, or bundled offers.

Rental Packages or services with dynamic pricing based on seasonal demand.
26.4 Goodwill basis
This Price Guarantee is offered at the discretion and goodwill of Cosy Camp to enhance your shopping experience. Cosy Camp reserves the right to decline, limit, or withdraw a claim under this policy if, in its reasonable opinion, the claim does not meet the intent of the guarantee. Cosy Camp’s decision is final and binding.
